Article 2 — Purpose and Scope

The purpose of these GTC is to define the rights and obligations of the parties in connection with the following activities:

  1. the sale of wines and products from the domain, remotely and on-site;
  2. domain tours and tastings;
  3. accommodation in guest rooms;
  4. the organization of events and the privatization of venues or services.

The provisions of this Title I apply to all these activities. Each subsequent title contains specific provisions that take precedence, in case of contradiction, over the common provisions.

Article 3 — Acceptance of GTC

Any order, reservation, or purchase implies the Client's unreserved acceptance of these GTC, which prevail over any other document. The Client acknowledges having read them before validating their order or reservation. The Domain reserves the right to modify the GTC at any time; the applicable conditions are those in force on the date of the order or reservation.

Article 4 — Prices

Prices are indicated in euros, all taxes included (TTC). Any delivery fees, tourist tax, or ancillary services are specified before the validation of the order or reservation. The Domain reserves the right to modify its prices at any time; products and services are invoiced based on the rates in force at the time the order is registered.

Article 5 — Personal Data

The data collected is necessary for processing orders, reservations, invoicing, and, if applicable, for sending commercial information with the Client's consent. The data controller is the Domain.

In accordance with Regulation (EU) 2016/679 (GDPR) and the "Informatique et Libertés" law, the Client has the right to access, rectify, erase, oppose, limit, and port their data, exercisable at the address [To be completed: GDPR contact email]. Data is kept for the period necessary for the purposes pursued and for legal obligations (particularly accounting). The Client can lodge a complaint with the CNIL.

Article 6 — Intellectual Property

All elements of the site (texts, photographs, logos, brands, layout) are protected by intellectual property law and remain the exclusive property of the Domain or its partners. Any reproduction or use without prior written authorization is prohibited.

Article 7 — Complaints and Consumer Mediation

Any complaint must be addressed first to the Domain by email or mail to seek an amicable solution.

In accordance with articles L612-1 et seq. of the Consumer Code, the consumer Client has the right to use a consumer mediator free of charge, after a prior written complaint has remained unanswered for a period of one year. The mediator designated by the Domain is:

Consumer Mediator: [To be completed — mandatory: name of the approved organization, postal address, and website]
Important note: adhesion to a consumer mediation scheme and the mention of the competent mediator are mandatory for any professional dealing with consumers. This mention must be completed before going online. The European Online Dispute Resolution (ODR) platform was definitively closed on July 20, 2025: no link to this platform should appear in the GTC.

Article 8 — Force Majeure

The Domain's liability cannot be engaged in case of non-performance due to a case of force majeure within the meaning of article 1218 of the Civil Code (in particular exceptional bad weather, natural disaster, administrative measure, strike, failure of a supplier or transport service provider).

Article 9 — Applicable Law and Disputes

These GTC are subject to French law. Failing amicable resolution or mediation, any dispute falls under the competent French courts. For the consumer Client, the rules of territorial jurisdiction provided for by the Consumer Code and the Civil Procedure Code apply.

Title II — Online Wine Sales

Alcohol abuse is dangerous for your health. Consume in moderation.

Article 10 — Prohibition of Sale to Minors

In accordance with articles L3342-1 and L3353-3 of the Public Health Code, the sale of alcoholic beverages to minors under 18 years of age is prohibited. By placing an order, the Client certifies on their honor that they are at least 18 years old and acknowledges that the Domain reserves the right to request proof of age at any time, particularly upon delivery. The order can only be validated after confirmation of this age condition.

Article 11 — Products

The products offered are described with the greatest possible accuracy. Photographs and descriptions have no strict contractual value; vintages, alcohol levels, and availability may vary. Offers are valid while stocks last. In case of unavailability after ordering, the Client will be informed and reimbursed for the corresponding amounts.

Article 12 — Order

The Client selects their products, checks the details of their order, and then validates it. The sale is concluded when the Domain confirms the order by email. The Domain reserves the right to refuse or cancel any order from a Client with whom a dispute exists, or in case of an abnormal order (especially quantities manifestly incompatible with personal consumption).

Article 13 — Payment

Payment is made by the means offered during the order, via a secure payment solution. The order is processed only after effective payment. Products remain the property of the Domain until full payment of the price (retention of title clause).

Article 14 — Delivery and Transfer of Risks

Deliveries are made to the addresses and in the geographical areas indicated during the order, by the carrier chosen by the Domain. Delivery times are given for information purposes only.

  • Areas served: [To be completed]
  • Delivery costs: [To be completed]
  • Estimated delivery times: [To be completed]

Alcohol delivery requires the presence of an adult; proof of age may be required. In accordance with article L216-4 of the Consumer Code, the risk of loss or damage to products is transferred to the Client when they (or a third party designated by them) physically take possession of the products. The Client is invited to check the condition of the package upon receipt and to make any reservations to the carrier.

Article 15 — Right of Withdrawal

In accordance with articles L221-18 et seq. of the Consumer Code, the consumer Client has a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal, without having to give reasons for their decision.

  • The Client notifies their decision by an unambiguous statement (letter or email), or by using the standard form provided in the appendix.
  • Products must be returned in their original condition and packaging, unopened and suitable for resale, within 14 days of notification.
  • Return costs are borne by the Client, unless otherwise specified.
  • Reimbursement takes place within 14 days from the recovery of the products or proof of their shipment.
Exceptions: in accordance with article L221-28 of the Consumer Code, the right of withdrawal does not apply to goods unsealed after delivery that cannot be returned for hygiene reasons, nor to goods likely to deteriorate or expire quickly. An opened or unsealed bottle cannot therefore be subject to withdrawal.

Article 16 — Legal Guarantees

Regardless of any commercial warranty, the Domain remains bound by:

  • the legal guarantee of conformity (articles L217-3 et seq. of the Consumer Code), allowing the Client to obtain the replacement or refund of a non-conforming product;
  • the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).

To assert their rights, the Client sends their request to the Domain describing the observed defect.

Title III — Tours & Tastings

Article 17 — Reservation

Tours and tastings are offered by reservation, on a specific date and time, within the limits of available places. The reservation is confirmed by email after, if applicable, payment of all or part of the price.

Article 18 — Absence of Right of Withdrawal

In accordance with article L221-28 (12°) of the Consumer Code, leisure services provided on a specific date or according to a determined periodicity do not benefit from the right of withdrawal. The reservation of a tour or a tasting is therefore firm and governed by the cancellation conditions below.

Article 19 — Modification and Cancellation

Conditions applicable to cancellations initiated by the Client:

  • Cancellation more than [To be completed: e.g. 48 h] before: [To be completed: e.g. postponement or full refund]

In case of cancellation by the Domain (including insufficient staff or force majeure), the Client will be offered a postponement or a full refund of the amounts paid.

Article 20 — Procedure and Safety

The Client undertakes to respect the safety instructions and the domain's regulations. Alcohol tasting is strictly reserved for adults; no alcoholic beverages are served to minors. The Domain encourages moderate consumption and may refuse to serve anyone in a state of intoxication.

Alcohol abuse is dangerous for your health. Consume in moderation.

Title IV — Guest Rooms

Article 21 — Purpose

The Domain offers accommodation in guest rooms including overnight stay and breakfast, in compliance with applicable regulations (limited to five rooms and a maximum capacity of fifteen people). The stay takes place as part of a host's welcome.

Article 22 — Reservation and Deposit

The reservation becomes firm upon receipt of the Client's agreement and payment of the requested deposit.

  • Deposit / Earnest money amount: [To be completed: e.g. 30% of the stay]
  • Balance: paid [To be completed: upon arrival / upon departure]
Nature of amounts paid: unless otherwise stipulated, the amounts paid upon reservation constitute earnest money within the meaning of article 1590 of the Civil Code. Consequently, in case of cancellation by the Client, they lose the earnest money paid; in case of cancellation by the Domain, the latter refunds double the earnest money.

Article 23 — Absence of Right of Withdrawal

In accordance with article L221-28 (12°) of the Consumer Code, accommodation services provided on a specific date are not subject to the right of withdrawal. The reservation is firm and governed by the cancellation conditions below.

Title V — Events & Privatization

Article 27 — Purpose

The Domain can organize or host events (receptions, seminars, weddings, workshops, privatization of spaces, etc.). Each service is subject to a specific quote or contract detailing the program, included services, capacity, and price. The accepted quote or contract supplements these GTC and prevails in case of discrepancy.

Article 28 — Reservation and Down Payment

The reservation of an event becomes firm upon signing the quote or contract and paying the indicated down payment.

  • Down payment upon reservation: [To be completed: e.g. 30%]
  • Balance: due [To be completed: e.g. 15 days before the event]

Article 29 — Absence of Right of Withdrawal

Leisure and catering services provided on a specific date are not subject to the right of withdrawal (Article L221-28, 12° of the Consumer Code). The booking of an event is firm and governed by the cancellation conditions set out in the quote or contract.
